Asad Raza calls me Crazy! Asad linkfest!

It’s hard to know where to go with this when I could do a 100 page book every day.

The short story is Dr Asad Rasa had a website where he complained that Canadians were not good enough for him,

Asad day after day sent emails into bluehost until they finally shut me down, presumably when a lawyer on Asad’s behalf called them. Though he’s never mentioned a law firm to any blogger I know of. Then in desperation I sent an email out to everyone I could think of. Many linked to at the bottom helped spread the word.  The strategy worked, I know Bluehost was probing other blogs carrying the story that made them look like schmucks. Websites that they do not host and cannot arbitrarily shut down! Bluehost finally contacted to tell me I’m unsuspended. I think that telling me I have no ability to get fair use is insane. However I have been emailed dozens of emails of his threats sent to me and other bloggers, I will treasure them all. They go from hostile to insane later on when Asad starts telling me to shut down other peoples blogs. Too bad I wasn’t ordered to shut down Dawgs blog or some other lame lefty.  But BCF and Binks who Iève linked to a lot over the last few years.

Asad should have twigged Friday night. That when Bluehost brought my site back up that he didn’t have a legal leg to stand on yet the threats kept coming.  I could have called this stupidity off with a couple of snarky posts and moved on. But he has threatened who knows how many bloggers.  I’ve seen enough emails where yesterday he said even though M.A.D. is back he’s going to sue for defamation because I don’t have the right to link to his name or his web archive, arg.

So that’s where it stands now. Like an 11,000,000 threat over my head for having the temerity to mention Asad’s name. And he’s going to people telling them that I’m responsible for every post in the blogosphere, telling people to block my IP address for posts they themselves made.

Some of the details below.

Asad says

this is a simple matter, all he has to do is remove two things. A link and my name.

So sayeth the anti free speech thug.  Is it really simple?  Based on what? You Asad, want to remove my right Number 2 from the Canadian Charter of Rights and Freedoms by telling me what I can and cannot say!  Every country in the west has freedom of speech in one form or another.  Even Denmark.

I mean a lot of bloggers are reading what you wrote and saying they agree yes it’s cold here but AGW will save us on that one.  So you said something you don’t agree with we all do.  Live with it, say you no longer agree, but don’t bloody well tell me I can’t quote you because you don’t believe in fair use.

Section 107 contains a list of the various purposes for which the reproduction of a particular work may be considered fair, such as criticism, comment, news reporting, teaching, scholarship, and research. Section 107 also sets out four factors to be considered in determining whether or not a particular use is fair:

1. The purpose and character of the use, including whether such use is of commercial nature or is for nonprofit educational purposes

Am I for profit?
Am I criticizing and commenting on his PUBLIC work?
Am I teaching?
Are bloggers news reporting?

I would say yes to all 4, who other than Asad wouldn’t?

So now I have to continue to pursue legal action against him. As this has gone from a simple request to have my name removed to a clear cut case of slander and defamation. Not sure why he has gone this route? I think he is digging his own grave.

So he’s plotting legal action against me for,……
You Asad are trying to take away my charter rights by telling me screw your fundamental freedoms under section 2 of the charter of rights.

Asad has the right to arbitrarily take your rights away based on what I do not know.

a) freedom of conscience and religion;
b) freedom of thought, belief, opinion and expression, including freedom of the press and other media of communication;

Asad just wants to take those deeply ingrained freedoms away from me, Asad says that taking away my fundamental freedom is a simple matter. If I cannot mention your name in an article you posted on the world wide web I have none of that.  Sure it might have been different wherever you came from, but tough you are here.  If you don’t want freedom of the press move to Russia or Saudi Arabia, you might be more comfortable.

Asad is the whole immigration thing in a nutshell when you hear people prattle on about bringing in immigrants from the stone ages to a modern and democratic society he is the reason people say it fails. He came here but doesn’t have even the basic concepts, first he wants to keep stoking the fires by threatening 10+ bloggers with legal action. No one thinks he has a leg to stand on. But like Incognito says

There are some who obviously have no clue about the concept of ‘freedom of speech’, or ‘public domain’, ‘fair use’ or what the definitions of slander, defamation and libel are. Perhaps it’s because freedom, let alone free speech, doesn’t exist in the countries they emigrated from,

That’s the crux of it he doesn’t think I have the right to Razz Raza, but I do.

Last week when disabled his website, he went crazy.

Just in the past few days he posted numerous slanderous and defamatory posts about me, my life, my religion etc on numerous blogs all over the internet:

Note He is saying that I started BCF and Binks 2 of my favorite blogs last week. I mean this isn’t just libelous it’s stupid No one not even dawgs blog is going to believe I started BCF last week. This guy would have been good at a Stalinist trial.

No one believes these lies about me for a single second.  I started BCF last week?  Binks too?  I mean that is not only stupid, you are also libeling me Asad, you know why it’s libel because you said I did something I did not do.

Why not these Asad? Why aren’t they getting your threats and being in emails? [USA]

Funny I have yet to see one post that agrees with your inalienable right to not mention your name the right to not link to your archive and ask is he your doctor,  maybe Wendy will put one up in your favour, when she’s done her nails.  Or maybe you’ll think I’m the good cop.

Jury awards $11.3M over defamatory Internet posts

A Florida woman has been awarded $11.3 million in a defamation lawsuit against a Louisiana woman who posted messages on the Internet accusing her of being a “crook,” a “con artist” and a “fraud.”

Legal analysts say the Sept. 19 award by a jury in Broward County, Fla. — first reported Friday by the Daily Business Review — represents the largest such judgment over postings on an Internet blog or message board. Lyrissa Lidsky, a University of Florida law professor who specializes in free-speech issues, calls the award “astonishing.”

BEWARE OF BLOGS: Courts are asked to crack down on bloggers, websites

Lidsky says the case could represent a coming trend in court fights over online messages because the woman who won the damage award, Sue Scheff of Weston, Fla., pursued the case even though she knew the defendant, Carey Bock of Mandeville, La., has no hope of paying such an award. Bock, who had to leave her home for several months because of Hurricane Katrina, couldn’t afford an attorney and didn’t show up for the trial.

“What’s interesting about this case is that (Scheff) was so vested in being vindicated, she was willing to pay court costs,” Lidsky says. “They knew before trial that the defendant couldn’t pay, so what’s the point in going to the jury?”

Scheff says she wanted to make a point to those who unfairly criticize others on the Internet. “I’m sure (Bock) doesn’t have $1 million, let alone $11 million, but the message is strong and clear,” Scheff says. “People are using the Internet to destroy people they don’t like, and you can’t do that.”

Like several other emails he’s ordering me to shut down other websites time after time.  If he was my doctor I’d want to talk long and hard with the pharmacist before taking any prescriptions.

If we do receive such official notice, the website will remain down according to the request of the court(s) at that time.

Guess I didn’t go quietly, but dearest Raza what is the name of the lawyer who sent you that? Who keeps the name of their lawyer secret?
Some are saying no lawyer would have written that.

    It would have been better if Bluehost were ballsy enough to restore their service, but probably no dice from that direction.

      Yes it would have been better if Bluehost had shown some commitment to free speech. Any.

      Oh well they have over a million blogs I’m but one drop in the bucket.
